Terms of Service

1. About these terms
These Terms of Service ("Terms") govern access to and use of HirioDB — the hosted document database engine, the web dashboard, the "HirioDB Compass" desktop client, and the "hiriodb" Node.js SDK (together, "the Service"), operated by HirioDB ("we", "us", "the provider"). You can reach us at payments@hirio.ro. By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you're accepting on behalf of a company, you confirm you have authority to bind that company.
2. Eligibility and your account
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You're responsible for the accuracy of the information you provide and for keeping your login credentials confidential — activity under your account is treated as authorized by you unless you notify us of unauthorized access.
3. Plans, pricing, and billing
HirioDB currently offers two subscription plans — Starter and Standard — each billed monthly in advance through Stripe, our payment processor. Prices are shown in US dollars and may be subject to applicable taxes, collected and remitted as required by law. Your subscription renews automatically at the start of each billing period until you cancel; canceling stops future renewals but does not refund the period already paid for. If a renewal payment fails, we may suspend the databases on your workspace until payment succeeds — your stored data is not deleted solely because of a failed payment.
4. Right of withdrawal for digital services
If you are a consumer within the European Union, you generally have the right to withdraw from a distance contract within 14 calendar days without giving a reason. However, because the Service grants immediate access to digital content and functionality upon subscribing, by completing checkout you expressly request that we begin performing the contract immediately and you acknowledge that your right of withdrawal is lost once that access has been provided in full, in accordance with applicable consumer protection law. This does not affect your separate, ongoing right to cancel your subscription at any time as described in Section 3 and Section 9.
5. License codes
Some access is granted through single-use license codes issued for a specific email address rather than a direct subscription — for example after a Stripe purchase, or issued manually by us for support or promotional purposes. Each code can only be redeemed once, by the exact email address it was issued for, and grants access for the plan and duration stated at issuance.
6. Acceptable use
You're responsible for the content of your databases and for keeping your connection strings and credentials confidential. You may not use the Service to store or process content that is unlawful under applicable law, to attempt to disrupt, reverse-engineer, or gain unauthorized access to our infrastructure, to circumvent usage limits associated with your plan, or to resell or sublicense access to your subscription without our prior written agreement.
7. Your data and our access to it
You retain all rights to the data you store in your databases. We access it only to the extent necessary to operate, secure, and support the Service (for example, troubleshooting an issue you report, or preventing abuse of shared infrastructure), and never to use its contents for our own purposes. You are responsible for ensuring you have the legal right to store any personal data of third parties in your databases and for complying with applicable data protection law with respect to that data.
8. Availability and support
We work to keep the Service available and your data durable, and to provide the support level described for your plan, but the Service is provided on an "as is" and "as available" basis without a guarantee of uninterrupted or error-free operation. We recommend maintaining your own backups of anything you cannot afford to lose, as you would with any database provider.
9. Cancellation and termination
You may cancel your subscription at any time from your dashboard's License page or through Stripe's billing portal; cancellation takes effect at the end of the current billing period. We may suspend or terminate access for accounts that violate these Terms, including abusive use of shared infrastructure or non-payment. Where we terminate for cause, we will make reasonable efforts to notify you first, except where immediate action is necessary to protect the Service or other users.
10. Liability
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, except where such limitation is not permitted by law (including, where applicable, in respect of consumer rights that cannot be limited or excluded).
11. Complaints and dispute resolution
If you have a complaint, contact payments@hirio.ro first and we'll do our best to resolve it directly. If you're a consumer in the EU and we can't resolve a dispute between us, you may also refer it to the European Commission's Online Dispute Resolution platform, or to the relevant consumer protection authority in your country of residence.
12. Changes to these terms
We may update these Terms as the Service evolves. For material changes, we'll make reasonable efforts to notify existing account holders by email in advance. Continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws of your country of residence provide otherwise. Nothing in these Terms limits any statutory rights you have as a consumer that cannot be waived by agreement.
